1. Agreement to Terms

By accessing or using the Apex Design website, purchasing our physical hardware kits, or utilizing our DXF Layout Software (collectively, the "Services"), you strictly agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Software License and Passkeys

The DXF Layout Software is licensed, not sold. Your purchase of an Apex Design hardware kit includes a single, non-transferable lifetime passkey to use the software. You agree not to distribute, share, reverse-engineer, or resell your passkey or the software itself. Apex Design reserves the right to revoke access to the software without refund if unauthorized sharing or abuse of the passkey is detected.

3. Physical Products and Hardware

Our physical jig assemblies are manufactured using premium DMLS 3D printed aluminum. While we strive for extreme precision and durability, they are intended for professional fabrication use. Due to the nature of 3D printing and industrial manufacturing, minor cosmetic variations may exist that do not affect the mechanical functionality of the tools.

Apex Design is not liable for structural failures, ruined materials, or personal injury resulting from improper use, overloading, or incorrect setup of our jigs. The user assumes all risk and responsibility for ensuring their welding and fabrication setups are safe and secure before tacking or welding.

4. Pre-orders and Shipping

Products listed as "available for pre-order" denote items that are currently in production or awaiting final QA. Lead times provided on the website are estimates and are subject to change based on manufacturing variables. We will make every effort to communicate delays promptly to the email address provided at checkout.

5. Limitation of Liability

In no event shall Apex Design, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

6. Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
