Terms of service
These terms cover two things: this website, and the Tube Shop software — the Fusion 360 add-in. Using either means you accept them. They are written to be read, so read them; section 05, on verifying output, is the one that will matter to you in the shop.

What Apex Design sells
Apex Design is a trade name of Trinity Carbon Works LLC, a limited liability company formed in the Commonwealth of Virginia and doing business as Apex Design. Trinity Carbon Works LLC is the party you contract with under these terms.
Apex Design sells software. Checkout runs through Polar, the merchant of record — theirs is the name on the charge. The Modular Jig System kits are no longer offered for sale; kits bought while they were listed are covered by the terms and the refund policy in force on the day of that sale.

The licence
Tube Shop is licensed, not sold. Buying it gives you a perpetual licence: it does not expire, and it does not stop running if you stop paying for anything else. Your licence key is issued when the payment clears, is bound to the email address you bought under, and covers the Tube Shop add-in for Fusion 360. Any other Apex Design application is licensed separately and is not included in this purchase.
- One licence, one shop. The licence covers a single shop — one business location — on machines you own or control. Install it on the machines in the shop; a two-man shop with three computers needs one licence, not three.
- Machines change, the licence stays. A dead computer is not a dead licence. Activate on the replacement with the same email and key — there are no dongles and nothing to transfer.
- It stays with the shop. The licence is not transferable to another business and may not be resold.
- The startup check. At startup the software may contact our licence server to validate your key, sending only the licensed email address and the key itself. If the server is unreachable, the software keeps working. It transmits no design, shop or usage data — your models never leave the building.
The licence agreement you accept at install (the EULA in the installer) is the licence document for the software itself; this page covers the purchase and this website.

What the licence permits
You may:
- Use Tube Shop commercially, for your own work and for your customers' work, with no royalty and no per-part fee.
- Keep, sell, publish or hand over anything you produce with it. Cut lists, bend sheets, wraps, G-code, DXF, STEP and IGES belong to you. Apex Design claims no rights in your designs or your output.
- Install updates you are entitled to and keep local backups.
You may not:
- Share, resell, sublicense or publish the software or your licence key.
- Reverse-engineer, decompile or work around the licensing, except where the law says you may regardless of this agreement.
- Sell access to Tube Shop as a service to third parties, or run it as a bureau on someone else's behalf under your licence.
If a licence key is being shared beyond what the licence covers, we may deactivate that key. We will contact you first and give you a chance to sort it out.

Buying, and refunds
The licence is $2,500.00, one time, with the first 12 months of maintenance included. The key is delivered at purchase — emailed to the address you bought under and shown on the pickup page your checkout lands on.
Refunds: It activates and runs on your machine or you get your money back — 7 days to report it. A change of mind is not a refund. The refund policy is part of these terms — what qualifies, the 7-day reporting window, and how to ask are all there.

Verify the output before you cut
This is the important part. Tube Shop computes cut lengths, developed lengths, bend positions, rotations, cope profiles and G-code. Those numbers drive machines and consume material. Check them before you commit.
- Calibrate each die from your own test bend, and re-check it when you change material, wall or supplier. Springback and wall variation are real, they differ between batches, and the software cannot see them.
- Cut a first article and measure it before running a set. A developed length that is wrong is wrong on every part.
- Dry-run G-code and confirm clamp, chuck and fixture clearance on your own machine. The post is configurable, which means it can be configured wrong.
- Confirm that tube size, wall thickness and cage geometry meet whatever rulebook applies to the job. Tube Shop does not know SFI, NHRA or FIA rules and it certifies nothing.
The operator is responsible for verifying output before cutting, bending or welding. Apex Design is not responsible for scrapped material, machine damage, missed deadlines, failed inspection, or injury arising from output that went to a machine unverified. That is not a disclaimer we hide behind — it is how every competent shop already runs.

Maintenance
After the included 12 months, maintenance is $500/yr and optional every year. It is updates and new post-processors, not permission: let it lapse and the version you have keeps working, exactly as it did the day it shipped. Cancel any time to stop future renewals — a renewal that has already charged stands, so put the date on the shop calendar the day you buy.

No warranty
The software is provided as is. We do not warrant that it is free of defects, that it will run on any particular machine, or that it is fit for a particular job. Tube geometry, machines and materials vary, and only you can judge whether the output suits the work in front of you.
Nothing here removes rights you have under consumer law that cannot be waived.

Limitation of liability
Apex Design is not liable for indirect, incidental, special or consequential damages — lost profit, lost work, scrapped material, downtime or goodwill — arising from the software or this website.
Total liability for any claim is limited to the amount you paid for the software licence.

Autodesk and Fusion 360
The add-in runs inside Fusion 360, which is Autodesk's product, not ours. You need your own valid Fusion licence to use it. Autodesk can change Fusion and its API at any time, and a change on their side can break the add-in until we catch up. Fusion 360 is a trademark of Autodesk. Apex Design is not affiliated with, endorsed by, or sponsored by Autodesk.

Changes to these terms
We may revise these terms. The licence you already bought stays governed by the terms in force on the day you bought it — a later revision does not reach back and change what you paid for. Continuing to use the website or to buy new licences after a revision means accepting the revised terms.

Governing law
These terms and the software licence are governed by the laws of the Commonwealth of Virginia, excluding its conflict-of-law rules — the same law the EULA in the installer names, so the purchase and the software point at one jurisdiction.
